Dick,

As Gordon said, you need a Coast Guard license to take passengers for 
hire.  The "six-pack" license is the minimum level.  I don't recall
the official name, but it has something to do with uninspected vessel.
Part of getting a CG license is being tested on the rules, so that
will answer the rest of your questions in more detail.

Someone mentioned a boat having to be in continuous US ownership,
but that relates to having the boat documented.  That's not the
issue here.  The Jones Act requires that vessels in trade between
US ports be American-built.  It is possible to get an exemption,
but it's not trivial.  There was some talk a few years back about
relaxing this law, but I don't know if anything came of it.

None of the above applies to a bare-boat charter, if you're willing
to let strangers take your boat without you being on board.
